Question(s) For Expert Witness

  • 1. Can you review the medical records and perform an IME to draw a conclusion on the cause and nature of the shoulder injury sustained by this patient?

Expert Witness Response E-006760

The operating room staff is responsible for the care of the patient under anesthesia. The incident, as described, should never happen under any circumstances. That said, I am happy to review the medical records and perform an IME of this patient to draw a conclusion on the cause and extent of the patient’s shoulder injury.

Expert Witness Response E-000055

The responsibility for patient safety during orthopedic surgery can fall on different individuals depending on the policy of the hospital/area. Often the ultimate responsibility lies with the Surgeon. I am able to take a look at the medical records, perform an IME on the patient and opine on the shoulder injury.
