The royalties earned from statutory licenses for these digital performances were placed in a fund that was managed by several entities. Allegedly, the trustees of the fund failed to properly identify and pay the non-featured artists the royalties they earned. An expert in the distribution of royalties from funds was sought to review the case and opine on whether or not the trustees breached their fiduciary duties to the non-featured artists.
